Terms and Conditions

PLEASE READ THESE TERMS AND CONDITIONS OF PARTICIPATION IN THE PURPL LUX SUBSCRIPTION PROGRAM CAREFULLY. BY PARTICIPATING IN THIS PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, PLEASE DO NOT PARTICIPATE IN THIS PROGRAM.

YOUR PURPL LUX MEMBERSHIP IS CONTINUOUS AND WILL AUTOMATICALLY RENEW EACH MONTH OR EACH YEAR DEPENDING ON YOUR SUBSCRIPTION PROGRAM UNLESS AND UNTIL YOU CANCEL OR WE TERMINATE YOUR ACCOUNT IN ACCORDANCE WITH THESE TERMS AND CONDITIONS. YOU MAY CANCEL YOUR MEMBERSHIP AT ANY TIME.

The Program is void where prohibited or restricted by law. The Purpl Lux subscription program (the "Program" or "Purpl Lux") is offered at the sole discretion of FragranceNet. This policy is a part of our general Terms of Use.

1. Program Eligibility and Membership

To be eligible for participation in the Program, you must be a United States resident, at least eighteen (18) years of age or older. We will not collect personally identifiable information from any person that is actually known to us to be a child under the age of eighteen (18). The Program is available only to individuals for their personal use and is limited to one (1) account per email address.

By joining the Program, you agree (or in the case of a Minor participant, the parent or legal guardian of such Minor must agree on the Minor's behalf) that you have read, understood and agree to be bound by these Program Terms and Conditions ("Terms") and by any changes or modifications that we may make hereto and all terms incorporated by reference. We reserve the right to change or terminate the Program at any time, as determined in our sole discretion in compliance with all applicable law. In the event of any change to the monthly or annual prepaid cost of the Program, we will notify you in writing using the email associated with your Program account at least seven (7) business days prior to the processing of your next monthly shipment. We further reserve the right to revise these Terms at any time in our discretion without prior notice to you.

You should review these Terms and the related FAQs frequently to understand the terms and conditions of the Program as they may change from time to time. When we make revisions or modifications to the Terms or related FAQs, they will be posted on the website at FragranceNet.com ("FragranceNet.com" or the "Website") and will be effective immediately upon posting and will supersede all prior versions of these Terms and/or related FAQs. These Terms do not alter in any way the terms or conditions of any other agreement that you may have with us, including any agreement for products or services.

By enrolling in the Program, you also agree to be bound by our Website Privacy Policy and Terms of Use, which are incorporated herein by reference. To the extent that these Terms conflict with our Privacy Policy or Terms of Use, these Terms shall control for purposes of the Program and our Privacy Policy will govern any information you submit in connection with the Program. Your continued participation in the Program after the posting of any revisions to its Terms and/or related FAQs shall confirm your acceptance of the modified Terms and/or related FAQs, therefore you should periodically review them to be aware of any changes. If you do not agree to these Terms, our Website Privacy Policy and our Website Terms of Use, you cannot participate in the Program.

We reserve the right, in our sole discretion, to terminate you from the Program for any reason, including but not limited to, your failure to comply with these Terms, any suspected abuse of the Program, illegal activity, fraud or other conduct that we may deem to be inconsistent with these Terms and/or the Program.

2. How the Program Works

Purpl Lux is a fragrance sampling subscription service that allows you to discover a new scent each month, expressly selected by YOU! Once you find your favorites, you can then purchase them in full sizes.

Eligible individuals may enroll in the Program online at FragranceNet.com. You must have a valid FragranceNet.com account to enroll in the Program. It is free to sign up and register for a FragranceNet.com account. If you do not have an account, you may either register for an account online or we will create one for you upon your submission of your email address and we will send you an email notification to create your account password. Once you are registered for your FragranceNet.com account, log in to your account and follow the prompts to enroll in the Program. Only one Program account may be associated with a single email address. In the event of a dispute over the ownership of a Program account membership, the Program member will be deemed to be the authorized account holder of the email address submitted at the time of registration for a FragranceNet.com account. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

By joining Purpl Lux, you are purchasing a continuous subscription and each month you will automatically receive one (1) 8ml/0.27 ounce travel atomizer sprayer filled with your fragrance scent of choice. Prior to each month's auto delivery shipment, you may log in to your account and select your scent for that month. You also have the ability to queue up scents in advance for your future monthly shipments, which may be queued up for a maximum of twelve (12) consecutive months in advance. Scents in your queue may be changed prior to your receipt of notice of shipment for that month, by logging in to your account and changing your scent selection. In addition, we may offer the opportunity to select Premium Products for your monthly shipment, at an upcharge that will be specified in bold underneath the Premium Product description on the Website. Any upcharge for a Premium Product will apply only to that Premium Product selected by you for that specific monthly shipment.

Upon enrollment, your first subscription shipment will arrive within 2-5 business days of placing your subscription order. Future subscription shipments will arrive once a month around the day you placed your initial subscription order. Approximately seven (7) days prior to each month's shipment, you will receive an email notification from us reminding you of your upcoming shipment for that month. You may freeze your subscription shipments for a maximum consecutive period of up to six (3) months or you may skip a monthly shipment by managing your subscription through your online account.

3. Program Cost and Payment Methods

We have monthly and annual subscriptions. Regardless of the option you select, you may cancel your subscription at any time. Shipping each month is free. Subscription shipments are only eligible to be shipped to the contiguous United States.

Monthly Subscription Program

The regular cost of the monthly subscription is $14.95 per month, plus applicable sales tax. If you select a Premium Product in any given month, you will be charged the upcharge associated with that Premium Product in addition to your monthly fee for that month.

Our Promotions

Annual Subscription Program

We also offer an annual prepaid option for an annual payment of $119.40 (for a discounted rate of $9.95 per month for a twelve-month period); at the end of the twelve-month prepaid term, your subscription will automatically renew for another year at the then-current subscription rate.

By enrolling in the Program, you understand and agree that: (1) you are purchasing a continuous subscription, (2) you will automatically receive a shipment each month, and (3) you are authorizing us to automatically bill you each month to your designated payment method at the then-current subscription rate (or, if you have elected the annual prepaid option, you authorize us to automatically bill you each month to your designated payment method at the end of the twelve-month prepaid term at the then-current subscription rate). The Program automatically renews each month. You may cancel your automatic subscription renewal any time by emailing us at subscription@fragrancenet.com or by managing your subscription.

There are no cancellation fees. Cancellations must be effected prior to the billing date of the monthly automatic renewal to avoid an automatic charge for that month. Cancellation of your subscription does not provide you a refund for any subscription already paid, nor does it stop a pending monthly charge. Your cancellation will go into effect for the following billing cycle. By using the self-service tool, you will be guaranteed immediate cancellation. If you opt to cancel your subscription by emailing us, you will need to provide us with your order number and email address and we will endeavor to process your request as quickly as possible, but please allow additional time for our processing of your request from the time at which you contact us by email.

You will be automatically charged each month to your designated payment method when your order has shipped. You may modify your payment method when you log in to your account. We reserve the right to cancel your monthly shipment and/or participation in the Program if your payment method on file is declined for any reason.

Changes To The Price And To Subscriptions Plans

We reserve the right to adjust pricing for our Program or any component thereof in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly provided for in these Terms, any price changes or changes to your Program subscription will take effect following written notice to you.

4. Privacy/Communications

We value and respect your privacy. The personal information that we collect from you in connection with the Program is subject to our Privacy Policy and will be used and disclosed by us for the purpose of administration of the Program, fulfilling your monthly shipments, marketing in connection with the Program, other marketing emails that you have opted in to receive and as otherwise permitted by our Privacy Policy.

By enrolling in the Program, you will be automatically subscribed to receive marketing emails from FragranceNet, including Program-related communications.

You may opt-out of receiving marketing emails from FragranceNet at any time by clicking the "unsubscribe" link in the email to manage your preferences or as otherwise provided in the FragranceNet Privacy Policy. You may choose to receive only Program-related communications. Examples of these communications include emails relating to your Program account, notification of your Program shipment or other Program service-related emails.
